By accessing or using the website marafrangipani.com or placing an order with Frangipani Flowers & Gifts ("Frangipani Florist", "we", "us", or "our"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

2. About Our Services

Frangipani Florist is a boutique floral studio based in Novato, CA, offering custom hand-crafted floral arrangements, wedding flowers, sympathy arrangements, orchids & plants, and subscription services. All bouquets and arrangements are personally designed by Mara Frangipani and hand-delivered to your door.

3. Delivery Area

We currently deliver exclusively within Marin County, California, including but not limited to:

  • Novato
  • San Rafael
  • Mill Valley
  • Sausalito
  • Corte Madera
  • Larkspur
  • San Anselmo
  • Tiburon
  • Fairfax

If your delivery address falls outside our service area, we will contact you to discuss alternatives or issue a full refund. See our delivery policy and rates.

4. Ordering

  • Orders may be placed through our website at any time. We will confirm receipt of your order by email.
  • All orders are subject to availability of flowers and staff scheduling. We will contact you promptly if we are unable to fulfill your order as requested.
  • For wedding, event, and party orders, please use the dedicated request forms on our website so we can provide a personalized quote. These orders require direct confirmation before being considered final.
  • Placing an item in your cart does not guarantee availability or reserve the item until the order is confirmed and payment is processed.

5. Pricing and Payment

  • All prices are listed in US Dollars (USD) and are inclusive of applicable sales tax where required.
  • Prices are subject to change without prior notice. The price shown at the time of checkout is the price you pay.
  • Payments are processed securely by Stripe. We accept major credit and debit cards. We do not store your card details on our servers.
  • Your card will be charged at the time your order is placed.

6. Cancellations and Refunds

Because our products are perishable, custom-made, and hand-crafted to order, our cancellation and refund policy is as follows:

  • Cancellations made at least 48 hours before the scheduled delivery date will receive a full refund.
  • Cancellations made less than 48 hours before delivery may be subject to a partial charge to cover materials already sourced and work already completed.
  • No refunds will be issued once an arrangement has been delivered, except in the case of a demonstrable error on our part (e.g., wrong item delivered, significant quality issue).
  • If you are dissatisfied with your arrangement for any reason, please contact us within 24 hours of delivery with a photo and description. We are committed to resolving all concerns promptly.

7. Product Substitutions

Flower availability is subject to seasonal and market conditions. If a specific flower or variety is unavailable, we reserve the right to substitute it with a bloom of equal or greater value and similar aesthetic. In such cases we will notify you prior to delivery. Our designer's choice arrangements are by nature flexible and may vary based on the freshest available blooms.

8. Designer's Choice & Custom Orders

For Designer's Choice arrangements, you select a budget and preferred style; the specific flowers chosen are left to the designer's creative discretion using the freshest available blooms.

Custom and bespoke orders require a consultation and written confirmation of the agreed design and price before work begins. Changes requested after confirmation may incur additional charges.

9. Subscription Services

Flower subscriptions are billed on the frequency selected at the time of sign-up. You may cancel or pause your subscription by contacting us at least 72 hours before your next scheduled delivery. Charges already processed for an upcoming delivery period are non-refundable unless cancellation occurs before the 72-hour window.

10. Intellectual Property

All content on this website — including text, photography, floral designs, logos, and graphics — is the property of Frangipani Flowers & Gifts and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this website for commercial purposes without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by California law, Frangipani Flowers & Gifts shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific order giving rise to the claim.

We are not responsible for delays or failures in delivery due to circumstances beyond our reasonable control, including but not limited to extreme weather, road closures, or supply chain disruptions.

12. Use of Website

You agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorized access to any part of the website or its related systems.
  • Transmit any harmful, offensive, or disruptive content through any feature of the website.
  • Use automated tools to scrape, copy, or index content from the website without our consent.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Marin County, California.
